2. Professional Relationship
Gahmy LLC acts as an independent contractor. Our services are intended for businesses and professional entities. By using our services, you represent that you have the legal authority to bind your business to these Terms.
3. Media Buying & Ad Spend
For clients utilizing our Paid Advertising services:
Ad Spend: Clients acknowledge that "Ad Spend" (the money paid directly to platforms like Meta/Google) is separate from Gahmy’s "Management Fees."
Payment Authorization: If Gahmy LLC manages ad spend on behalf of the client, the client agrees to fund the agreed-upon budget in advance.
Platform Compliance: We strive to adhere to all advertising platform policies; however, Gahmy LLC is not responsible for account suspensions or restrictions imposed by third-party platforms (e.g., Facebook Ads Manager).
4. Client Responsibilities
To ensure the success of our campaigns, clients agree to:
Provide accurate business information and necessary creative assets.
Grant necessary access to social media accounts and ad managers.
Review and approve campaign strategies and materials in a timely manner.
5. Payments & Billing
Invoicing: All services must be paid according to the terms specified in the individual service agreement or invoice.
Processing: Payments are processed securely via authorized third-party payment gateways.
Currency: All transactions are processed in U.S. Dollars (USD) unless otherwise agreed upon.
Delays: Failure to complete payments may result in the temporary suspension of active marketing campaigns or access to courses.
6. Refunds & Cancellations
Our refund policies vary based on the type of service (e.g., digital courses vs. managed services). Please refer to our dedicated Refund Policy page for detailed information.
7. Intellectual Property
Gahmy Property: All proprietary methods, templates, and educational content provided by Gahmy LLC remain our intellectual property.
Client Property: Creative assets produced specifically for a client (e.g., custom videos or copy) become the client's property upon full payment of all associated fees.
8. Limitation of Liability
While we utilize data-driven strategies to maximize results, Gahmy LLC does not guarantee specific sales figures, ROI, or profit outcomes. Marketing performance is subject to market conditions and consumer behavior beyond our control. Gahmy LLC shall not be liable for any indirect, incidental, or consequential damages.
9. Confidentiality
Both parties agree to protect and keep confidential any sensitive business information, trade secrets, or data shared during the course of the professional engagement.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.
11. Changes to Terms
